ELIGIBILITY: Sweepstakes is open to legal residents of the 50 United States, the District of Columbia and Puerto Rico, 18 years of age or older at time of entry. PROMOTION PERIOD: The Sweepstakes begins at 12:00:00 a.m. Eastern Time (ET) on July 7, 2022 and ends at 11:59:59 p.m. (ET) on August 15, 2022 (the “Promotion Period”). The Sponsors run the official clock for the Sweepstakes and will solely determine the time by which an entry is received. Proof of submission of entry does not constitute proof of delivery. No entry materials received by the Sponsors will be returned. Releasees assume no responsibility for lost, late, illegible, postage due, incomplete, garbled or misdirected, mutilated entry mail, human, or other error or for any technical or other malfunctions that may occur. No mechanically reproduced, illegible, or incomplete entries will be accepted. PRIZES: Three (3) Grand Prizes: Each Grand Prize Winner will receive a five (5)-night trip for Grand Prize winner and one (1) guest to Landaa Giraavaru, Maldives scheduled to take place 11/1/2022-11/6/2022. Trip includes round-trip coach air transportation from the major international airport nearest winner’s residence (guest’s transportation will be arranged from the same location as the winner) to Maldives, transportation to/from planned activities (to be determined by Sponsors), ground transportation to/from Landaa Giraavaru, Maldives airport (to be determined by Sponsors), one (1) standard double-occupancy hotel accommodations for five (5) nights determined by Sponsors, in their own discretion, select meals and activities (exact details to be determined by Sponsors), and one (1) $250 Mastercard Prepaid Card (for winner only). Plus, each Grand Prize Winner will also receive a check in the amount of $7,231.50, approximately 30% of the estimated value of the prize that may be used to assist with the payment of associated taxes. Depending upon the Winner’s federal tax rate, this amount may only cover a portion of the tax liability owed. Please consult a tax professional for more information. Approximate Retail Value (“ARV”) of each Grand Prize: $31,336.50 including tax assistance. Actual value of Prize may vary based on point of departure and existing rates at the time of booking and dates of travel. Any difference between stated ARV and actual value will not be awarded. Total ARV of Grand Prizes: $94,009.50. Seventy-five (75) First Prizes: Each First Prize winner will receive one (1) Smart Watch. ARV: $400 each. Total ARV of First Prizes: $30,000. Total ARV of all Prizes: $124,009.50. Odds of winning a prize depend on the total number of eligible entries received. No more than the stated number of prizes above will be awarded, provided a sufficient number of qualified eligible entries are received during the Promotion Period. Other restrictions may apply, and all details are subject to change. § Winners and guests must not have any medical, legal or any other reason that would prevent them from taking the prize. § Winners and guests are bound by the terms and conditions of all airlines, hotels and other third-party service providers used in connection with the Prize. § Grand Prize Winners will not receive cash or any other form of compensation if actual travel costs are less than the estimate made in these Official Rules. § In the event the trip is cancelled for any reason whatsoever, in whole or in part, including but not limited to cancellations, postponements, an event of force majeure, or for any other reason, then the remaining components of the Prize shall constitute full satisfaction of Sponsors prize obligation to the prize winner and his/her guest/travel companion, and no other or additional compensation will be awarded. § Sponsors are not responsible for any cancellations, delays, diversions or substitutions or any or any act or omissions by the airline, hotel, or any other persons providing any of these services and accommodations. GENERAL PRIZE CONDITIONS: All other Prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose) by Sponsors. Winning Athleta cardmember accounts must be in good standing in accordance with the terms described in the Credit Card Agreement in order to receive a prize. In the event of a dispute as to who submitted a particular cardholder entry, such entry will be deemed to be submitted by the primary person in whose name the card used to enter the Sweepstakes was issued. Winners are responsible for all federal, state and local taxes as well as all costs and expenses associated with prize acceptance and use not specified herein as being awarded. First Prizes will be sent to the winners’ addresses on file or provided on entry within four to six weeks of prize notification. No prize substitutions, cash equivalents or transfer of prizes are permitted, except by Sponsors in their sole discretion. WINNER SELECTION: A random drawing will be conducted on or about August 31, 2022 from among all eligible entries received (purchases and mail-ins) under the direction of Marden-Kane, Inc., an independent judging organization, whose decisions are final and binding in all matters relating to this Sweepstakes. PRIZE WINNER NOTIFICATION: The Potential Grand Prize Winners (a “Potential Winner”) will be notified within three (3) business days after the drawing date via email. The Potential Grand Prize Winners will be required to complete, sign and properly execute (including notarization) an Affidavit of Eligibility and Liability/Publicity Release (where applicable by law), and an IRS-W9 Form and furnish his/her social security number that will be used only for the purpose of reporting the Winner’s prize earnings to the Internal Revenue Service, as required by law; and return them by mail within five (5) days to Administrator. If a potential Prize Winner does not return the required documents within the stated timeframe, they will be disqualified, and an alternate Prize Winner will be selected as described above. In the event of non-compliance with these rules, or if the prize or prize notification is unclaimed or returned as undeliverable, the prize will be forfeited and, at Sponsors’ sole discretion, awarded to an alternate potential Prize Winner, time permitting. Upon prize forfeiture, no compensation will be given. If the prize is won by an eligible individual who is not of the legal age of majority in the state of residence (minor), the required documents must be confirmed and signed by winner’s parent or legal guardian, and the prize will be awarded in the name of his/her parent or legal guardian, who will be required to fulfill all requirements imposed on the winner set forth herein.
